IF YOU DIG UP SOIL anywhere in Ontario, you likely have an opinion on
O. Reg. 406/19 (On-Site and Excess Soil Management). Every new regulation comes with growing pains—but across the province, people are
rising to the challenges and tackling the issues head-on. Despite the
frustration, it’s also an exciting time in the industry.
Behind the scenes, several important initiatives are underway:
Bedrock challenges are being addressed through a newly formed
Bedrock Technical Working Group coordinated by the Quali昀椀ed Persons Community of Ontario (QPCO). This group brings together consultants, geotechnical engineers, laboratories, municipalities, reuse
sites operators, and the Ministry of Environment, Conservation and
Parks (MECP). A white paper is expected for public discussion this fall.
A leachate-focused working group through the Canadian Brown昀椀elds Network (CBN) is engaging with the MECP o n concerns around
the analysis of the modi昀椀ed synthetic leaching procedure (mSPLP),
particularly where curious results or overly conservative interpretations create barriers to reuse. The group is looking into case studies
and may suggest some alternatives.
